The tourist who accidentally killed five-year-old Otago girl Ruby Marris in a horrific crash will stay behind bars, following a judge's decision to dismiss an appeal against his jail sentence.

Chinese national Jing Cao, 32, was jailed for 18 months in June after crossing on the wrong side of State Highway 1, near Moeraki, and crashing into a local family travelling in the other direction.

Ruby died at the scene while her two sisters and parents received serious injuries.

Cao's lawyer Anne Stevens appealed the sentence earlier this week, arguing the judge had overestimated her client's culpability and went too far in an attempt to deter other offenders. She also contended the judge failed to take his remorse and prompt payment of more than $60,000 in reparation into account.
