A judge has found the case against an Auckland man who collided with a woman on a Lime scooter as she got off a bus in Auckland CBD was proven.
Judge Christopher Field ruled the case was proven against Mitchell McIntyre for careless or inconsiderate vehicle operation causing injury.
Debra Christensen received serious head injuries in the accident at a bus stop in Fanshawe St in June 2019. She says she doesn’t remember her feet touching the ground before waking up.
It’s believed to be the first prosecution in New Zealand arising from a Lime scooter operator’s actions.
McIntyre's lawyers argued it was Christensen’s responsibility to check left and right before alighting from the bus.
But the judge in the judge-alone case decided McIntyre was travelling too fast and failed to use his bell.
The sentencing will take place on Wednesday afternoon.
