David Benbow murder trial: Jury discharged after one member falls ill

The jury in the David Benbow retrial has on Tuesday morning been discharged and sent home.

Members were empanelled on Monday but one juror has fallen ill and cannot sit for the next two days. Justice Jonathan Eaton told the jury he was reluctant to start out with only 11 jurors in such a long trial.

The Crown and the defence were set to open their cases on Tuesday in a trial set down for eight weeks.

Benbow is on trial for murdering his childhood friend Michael McGrath in 2017. His first trial earlier this year ended in a hung jury after the seven men and five women couldn't agree.

A new jury is expected to be selected on Wednesday.
