A grand jury in the US will examine the evidence into the shooting and killing of 22-year-old Christchurch-born Christian Glass.
Glass was shot and killed by Clear Creek police in June this year.
"After a comprehensive investigation, I now intend to bring this matter to the grand jury," 5th Judicial District Attorney Heidi McCollum," said in a statement.
The move could result in charges being laid against the police officer who shot him.
Glass was shot and killed by Clear Creek County deputy Andrew Buen, CPR News reported.
The 22-year-old called US police after his car became stuck on a small pile of rocks on the side of the road in Silver Plume, Clear Creek County in Colorado.
During the call, Glass told police about the weapons he had in his car and told officers he would throw the weapons out the window when officers arrived.
Glass' family lawyers Qusair Mohamedbhai and Siddhartha Rathod said the 22-year-old was an amateur geologist and the weapons Glass had were rock knives.
After trying multiple times to negotiate with Glass to get out of the vehicle, police tasered and shot him five times resulting in his death.
McCollum also said in her statement: "It is imperative that we reach the right decision and not rush into judgment — in fairness to the family of the victim, and those involved with and impacted by Christian's death."
Glass' death was under review by the Colorado Bureau of Investigation as it is standard procedure if law enforcement is involved.
The grand jury is a step further as it holds subpoena power and can gather witness testimony under oath. It can also result in indictments. CPR News reported
Glass' parents Simon and Sally supported McCollum's decision to put the case to a grand jury.
"The wheels of justice are turning in the right direction, there is not an hour that passes that we do not think about our gentle son, Christian Glass.
"We are expecting accountability for those involved in his murder," Glass' parents said in a statement.
