An Australian couple is fighting a traffic fine after they discovered that photos capturing their breach showed the wife's underwear.

Richard Arnold and his wife Anh Nyugen were sent the photo and fine in the mail. 

The unsuspecting couple drove along a Gold Coast highway on December 19, 2022 when the photos were snapped.

Arnold claims the photos, which show his wife's skirt riding up, revealing her underwear, are both illegal and indecent. 

In one of the, Nyugen has her feet on the dashboard and her skirt not fully covering her underwear. She also had her arms outside of the seatbelt - the breach detected by the traffic camera.

Arnold is calling on traffic authorities for an apology and to revoke the fine which amounts to $1078.

"You don't expect to be sent pictures of your wife's underwear, I have to say," he told The Gold Coast Bulletin. 

"It's actually illegal, I think to photograph up a skirt."

A spokesperson from Queensland's Department of Transport and Main Roads said traffic camera photos were filtered with AI software.

The software detects potential breaches such as potential mobile phone or seatbelt offences.

An officer from the Queensland Revenue Office will then carry out a further assessment before issuing an infringement.

"Images are used only for enforcement purposes and are secretly encrypted and stored under current legislative requirements. Only images that may show an offence are viewed and retained by QRO."
