3 News has obtained footage of the attack taking place.
Police say they will be reviewing the video footage to see if charges can be laid.
Media spoke to Richards following the incident and he refused to admit it had taken place, despite the video footage.
"I pushed back when someone was trying to grab the megaphone off me," says Richards. "There was no violence."
The incident occurred during a large protest which involved scuffles with police.
Following Trevor Mallard's attack on Tau Henare, this is the second time within a fortnight that the Labour Party has made headlines in connection with physical violence.
