Firerose claims Billy Ray Cyrus filed for divorce one day before mastectomy, causing emotional distress

Australian singer Firerose claims her ex-husband Billy Ray Cyrus filed for divorce one day before she was due to undergo a double mastectomy.

Cyrus filed for divorce on May 23 after seven months of marriage.

US publication People magazine reported the news having seen court documents filed on June 14.

Firerose had been diagnosed as a carrier of the BRCA1 gene mutation in early 2020, which meant she had an increased likelihood of developing breast cancer.

She underwent an MRI in March, and doctors had "highly recommended" she undergo preventative surgery and a reconstruction.

The first surgery had been planned for May 24.

As the surgery approached, Firerose claimed that Cyrus "continuously launched verbal assaults" at her while threatening to kick her out of their home and file for divorce, People magazine reported.

"When Wife would attempt to voice certain concerns, Husband would often call her a 'selfish f**king bitch' and continually alleged that she was using him," the complaint said. 

"With Wife's major surgery date looming, she was reasonably afraid to leave or seek any type of help because she feared that Husband would interfere with her surgery or her lengthy recovery at home."

People also reported Cyrus had paid for Firerose's health insurance, and "was prepared" to pay for any surgery expenses that had not been covered by the insurance.

"Wife relied on Husband's promises to pay for her surgery, and Husband has now repudiated that promise," People said the documents claim. 

"On the day Wife was set to get her surgery, she was instead searching for a place to live and under a significant amount of emotional distress."

Cyrus cited "irreconcilable differences" and "inappropriate marital conduct" as the grounds for their split. Cyrus is seeking an annulment, alleging that he "gave consent to marriage based on fraud" by Firerose, according to the petition. If an annulment is not granted, Cyrus is asking the court for a divorce.

The pair became engaged in 2022 after first meeting on the set of Hannah Montana 12 years prior, according to a 2022 interview with Cyrus in People. They wed in Tennessee the following year.

This was Cyrus' third marriage and Firerose's second.
